This website is operated by Ecovine Studio Inc. (“Ecovine”, “we”, “us”, “our”). By visiting our site and/or purchasing something from us, you engage in our services (“Service”) and agree to be bound by these Terms of Service (“Terms”), including any additional terms and policies referenced herein.

These Terms apply to all users of the site, including browsers, customers, and contributors of content. If you do not agree to all Terms, you may not access the website or use our Services.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that enables us to sell products and Services.

We may update these Terms from time to time by posting an updated version on this page. Your continued use of the website after changes are posted constitutes acceptance of the updated Terms.

SECTION 1 — ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your province/territory of residence, or you have provided consent for any minor dependents to use this site.

You may not use our site, products, or Services for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit viruses, malware, or code of a destructive nature. A breach of these Terms may result in termination of your access to our Services.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse Service to anyone for any reason at any time, to the fullest extent permitted by law.

You understand that content you submit (excluding payment information) may be transferred unencrypted over networks and adapted to meet technical requirements. Payment information is handled through secure payment providers and is encrypted during transmission.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service or access to the Service without our express written permission.

SECTION 3 — ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

We are not responsible if information on this site is not accurate, complete, or current. The material is provided for general information only. Any reliance on site content is at your own risk.

SECTION 4 — MODIFICATIONS TO THE SERVICE & PRICES

Prices for products and Services are subject to change without notice.

We reserve the right to modify or discontinue the Service (or any part thereof) without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service, to the fullest extent permitted by law.

SECTION 5 — WORKSHOPS, BOOKINGS & ATTENDANCE (IMPORTANT)

5.1 Booking & Confirmation

Workshop bookings are completed through our website and/or approved booking tools. A booking is confirmed only after successful payment and receipt of a confirmation email/order record.

5.2 Materials & Natural Variation

Workshops involve natural materials (plants, moss, wood, stone, soil). The appearance of materials and final results may vary based on seasonal availability and natural variation. Photos are for reference.

5.3 Safety & Conduct

Workshops may involve glass containers, water, and tools (e.g., scissors/tweezers). You agree to follow instructor directions and behave safely and respectfully. We may refuse participation or remove attendees who act unsafely or disrupt the experience.

5.4 Partner Venues & Locations

Some workshops are hosted at third-party partner venues. Partner venues may have their own rules (e.g., food/drink policies, behaviour expectations). You agree to comply with reasonable venue rules. We are not responsible for the operations of third-party venues.

5.5 Allergies & Sensitivities

Natural materials may trigger allergies or sensitivities. You are responsible for assessing your own health situation and informing us of relevant allergies when appropriate. Participation is at your own discretion and risk.

5.6 Photography & Media Use

We may take photos or short videos during workshops for documentation, educational, and marketing purposes (including our website and social media). If you prefer not to appear in any photos or videos, please let us know so we can avoid capturing you. We appreciate your support in sharing our work.

SECTION 6 — WORKSHOP CANCELLATION, NO-SHOW & REFUND POLICY

All workshop reservations are final. We do not offer refunds for workshops.
Because workshop materials and live plants are prepared and allocated specifically for each customer upon reservation, cancellations and no-shows cannot be refunded. However, we offer following options in case you miss the workshop:

6.1 No-Show Materials Pickup

If you do not attend your workshop (“no-show”), we can pack the prepared materials for you to pick up, subject to the following:

  • Pickup must be arranged by contacting us at ecovinestudio@gmail.com.

  • Pickup location and time will be provided based on availability (and may be at our designated pickup point or partner venue when applicable).

  • Materials are prepared for workshop use. We do not guarantee identical results outside the guided workshop environment.

6.2 Rescheduling (Optional)

If we choose to offer rescheduling in specific cases, it is at our sole discretion and may be subject to capacity limits and notice requirements. 

SECTION 7 — PRODUCTS 

Certain products may be available exclusively online and may have limited quantities. We reserve the right to limit sales of our products to any person, geographic region, or jurisdiction, and to limit quantities offered.

We make reasonable efforts to display product images accurately, but we cannot guarantee your device’s display is accurate. Natural products vary in appearance.

For products involving live plants, you acknowledge plant health can be affected by conditions after pickup/delivery (light, humidity, watering, temperature, handling). Outcomes may vary.

Our glass jars are handmade. As a result, you may notice small variations or minor imperfections such as slight asymmetry, tiny air bubbles, or subtle surface marks. These natural variations are part of the handmade process and do not affect the overall function, durability, and therefore are not grounds for return or refund.

SECTION 8 — BILLING & ACCOUNT INFORMATION

We reserve the right to refuse, cancel, or limit any order. If we change or cancel an order, we may attempt to notify you via the email/phone provided at checkout.

You agree to provide current, complete, and accurate purchase and account information and to promptly update it so we can complete transactions and contact you as needed.

SECTION 9 — OPTIONAL TOOLS & THIRD-PARTY SERVICES

We may provide access to third-party tools or services (including booking apps) “as is” without warranties. Your use of third-party tools is at your own risk and may be subject to the third party’s terms.

SECTION 10 — THIRD-PARTY LINKS

Our site may include links to third-party websites. We are not responsible for third-party content, policies, or practices.

SECTION 11 — USER CONTENT, FEEDBACK & SUBMISSIONS

If you send us feedback, suggestions, or other submissions, you agree we may use them without restriction, without obligation to compensate you. You are responsible for ensuring your submissions do not violate any third-party rights or laws.

SECTION 12 — PERSONAL INFORMATION

SECTION 13 — PROHIBITED USES

You are prohibited from using the site or its content for any unlawful purpose, to violate regulations, infringe intellectual property, harass or discriminate, submit false information, transmit malicious code, spam/phish/scrape, or interfere with security features. We reserve the right to terminate access for violations.

SECTION 14 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

The Service and all products and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

To the fullest extent permitted by law, Ecovine Studio Inc. (including its owners, employees, contractors, affiliates, and partners) shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of the Service or any products/Services purchased through the Service.

Some jurisdictions do not allow certain limitations of liability; in such cases, liability will be limited to the maximum extent permitted by law.

SECTION 15 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Ecovine Studio Inc. and its affiliates, partners, officers, directors, agents, contractors, and employees from any claim or demand (including reasonable legal fees) arising out of your breach of these Terms or violation of any law or third-party rights.

SECTION 16 — SEVERABILITY

If any provision is determined to be unlawful, void, or unenforceable, the provision shall be severed and the remaining provisions shall remain in full force and effect.

SECTION 17 — TERMINATION

These Terms are effective unless and until terminated by you or us. We may terminate or suspend access to the Service at any time if we believe you have violated these Terms.

SECTION 18 — ENTIRE AGREEMENT

These Terms and any policies posted on this site constitute the entire agreement between you and us, superseding prior communications and proposals.

SECTION 19 — GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
